A Bronx landlord agreed to pay $70,000 to his tenant for a shoulder injury resulting from an accident in her aprtment caused by the landlord's failure to repair and maintain the building.

Bronx, NY (PRWEB) October 4, 2004 -- A Bronx landlord agreed to pay $70,000 to his tenant, Carmen Espinal, for a shoulder injury resulting from an accident in her apartment caused by the landlords failure to repair and maintain the building. What he did wasnt right and it caused my injury. Now he has to pay, said Ms. Espinal.

Ms. Espinal repeatedly complained about a water leak in her one bedroom apartment in the South Bronx. Her landlord, 500 Trinity Associates, made only half-hearted efforts to repair the problem or ignored her altogether. On January 31, 2000, Ms. Espinal entered her bathroom to clean the shower curtain. When stepping from the tub, her foot crashed through the water damaged floor and she fell to the floor. In the accident, she tore a ligament in her shoulder requiring outpatient surgery and rehab work.

Attorney Carol L. Schlitt, the trial lawyer for Ms. Espinal, said, Landlords have the obligation to keep their buildings in a reasonably safe condition. In this case, the landlord failed to do so despite repeated requests from my client. Ms. Schlitt built the case around evidence of the accident and the medical report on Ms. Espinals injury. This case sends a warning to all landlords: they need to heed the complaints of their tenants and maintain their buildings.
