WASHINGTON, D.C. -- Attorneys who negotiated a $50 million settlement give credit for much of the success to litigation support services provided by Esquire Litigation Solutions, LLC.
The support not only persuaded the plaintiffs to hold out for a larger settlement but also in all likelihood influenced the defendants to settle rather than go to trial.
The pre-trial preparation done by Esquire was so convincing that the $50 million settlement was reached within hours of the scheduled trial. Erik L. DeShields, lead litigation consultant for Esquire, was assisted by Daniel Shieh.
The legal support provided by Esquire was a very important factor in negotiating the settlement, stresses Joseph J. Zito, principal litigator for the plaintiffs, Mylan Pharmaceuticals Inc. and Esteve Quimica. The lawsuit, filed against Kremers Urban Development Company and Schwartz Pharma, involved patent rights over the process of how a pill was made and replicated.
Esquire put together a package of support services that helped the attorneys persuade the other side to settle the case, adds DeShields. We prepared data bases, exhibits; demonstrative evidence, and worked with them through three mock trials.

As it turns out, both sides used Esquire Deposition Services for depositions and transcripts, says Grandinetti. Esquire flew a court reporter to Barcelona, Spain, for a week and a half of depositions.
But very early on Levy, Zito and Grandinetti acquired the additional services of Esquire Litigation Solutions to handle all of our video presentations, electronic displays of exhibits and demonstrative evidence for use in trial, explains Grandinetti As we approached the trial we did a number of mock trials. The customized video presentations of witnesses was shown to mock juries who then evaluated and voted on numerous aspects of the evidence and on the credibility of witnesses for both sides.
Zito added: The excellent support services provided by Esquire allowed our clients to make a very accurate evaluation of the case and boosted their confidence to hold out for much more. The Friday before the trial was scheduled to begin we exchanged a lot of documentation and exhibits with the other side. I would like to think that the other side was moved to settle after viewing the Esquire presentation. I believe that documentation and exhibits were persuasive enough to push them toward settlement.
The trial exhibits included big screen and PowerPoint presentations on expert, technical testimony. The video support included recording the statements of witnesses during depositions and organizing the video presentations to mock juries.
