After a Queens New York jury found the Triboro Bus Company 100 percent liable for injuries suffered by Dianne Henry in a fall on one of their buses, the bus company agreed to pay her $60,000 in a settlement. Queens, NY (PRWEB) September 29, 2004 -- After a Queens New York jury found the Triboro Bus Company 100 percent liable for injuries suffered by Dianne Henry in a fall on one of their buses, the bus company agreed to pay her $60,000 in a settlement. Ms. Henry said, I am so grateful that the bus company took responsibility for the pain and anguish they caused me. The case Henry v. Triboro Coach stems from a July 3, 2001 accident on the Q23 Bus in Queens New York. That evening, Dianne Henry, working as a home health aide, helped her elderly patient onto the bus for a short trip home. The bus driver failed to ensure that his passengers adequately secured themselves on the bus, a direct violation of New York State safety codes. Ms. Henry said, I never had a chance to sit down next to my patient. The driver raced into an intersection in an effort to pass another vehicle. When he could not pass that vehicle, the bus driver slammed on the brakes, throwing Ms. Henry into a bus pole. She suffered face and neck injuries.
Attorney Carol L. Schlitt, the trial lawyer for Ms. Henry, said, A bus driver and bus company have an obligation to secure the safety of their passengers and they failed to do so in this case. A Queens jury agreed and found the bus company fully liable for Ms. Henrys injuries. Before proceeding to the damages part of the trial, Triboro settled the case by agreeing to pay Ms. Henry $60,000. Ms. Schlitt said, I hope this verdict will lead the Triboro Bus Company to improve the safety training for their drivers so passengers can ride with greater confidence in the future.
